Terms & Conditions
Last updated:
1. Who you are contracting with
This website is operated by REPLACE-LEGAL-BUSINESS-NAME. Tours are delivered by a licensed Ontario tour operator acting as our operating partner. By booking, you agree to these terms and to the operating partner's conditions of carriage.
2. Prices and what they include
- All prices are quoted in Canadian dollars (CAD) and are for the entire private vehicle, not per person, unless stated otherwise.
- The base price includes your vehicle, driver-guide, door-to-door pickup and drop-off within the stated service area, and gratuities.
- Admission to optional attractions — boat cruises, Journey Behind the Falls, observation decks, winery tastings, buffets and similar — is not included unless it appears on your written quote.
- Prices are confirmed on your quote. We reserve the right to correct pricing errors before a booking is confirmed.
3. Booking and payment
- Submitting an enquiry does not create a booking. A booking exists only once we confirm your date in writing and payment terms are met.
- Reserve-now-pay-later bookings hold your date; the balance is due by the date stated on your confirmation.
- You are responsible for giving accurate pickup details, guest numbers and contact information.
4. Cancellations, changes and refunds
Set out in full in our Cancellation & Refund Policy, which forms part of these terms. In short: free cancellation and free rescheduling more than 24 hours before departure; no refund inside 24 hours; full refund if we cancel.
5. Itinerary changes
Itineraries are indicative. Weather, traffic, road closures, attraction opening hours and group pace may require stops to be reordered, shortened or dropped. On a private tour the itinerary is yours to adjust on the day, subject to the total booked duration and your guide's legal driving-hour limits. Extending beyond your booked duration may incur an additional hourly charge, agreed at the time.
6. Your responsibilities
- Be ready at your pickup point at the confirmed time. Missed pickups are treated as no-shows.
- Tell us in advance about mobility requirements, child seats, medical needs or dietary requirements so we can send an appropriate vehicle and plan suitable stops.
- Behave lawfully and safely. Your guide may end the tour without refund for behaviour that is unsafe, abusive, or unlawful, including intoxication.
- Carry valid identification. This tour remains on the Canadian side of the Falls and does not cross into the United States.
7. Liability
We are not liable for indirect or consequential losses, including missed onward flights, trains, accommodation or events, arising from delays outside our reasonable control. Nothing in these terms limits liability for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited. Our maximum liability for any claim is limited to the amount you paid for the tour.
8. Insurance
We strongly recommend travel insurance covering trip cancellation, medical costs and personal belongings. Personal items are carried at your own risk.
9. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. Disputes are subject to the exclusive jurisdiction of the Ontario courts.
